Article publishing ignores Category Indexes excludes

I've add a new publishing rule (main category index) so that the top level categories use a different template to the sub categories. I've used 'include' to make this new rule only apply to the top level categoeries and have 'excluded' these from the normal Category Indexes publishing rule. Using Publish All, it works great. But if I create an article in a sub level say News: Latest News . The top level category (News) is published using the standard cateogory template not one created for top level categories. Publish All corrects this, but I can forsee a problem when I roll out the site and start to have Writers adding articles. I'm sure I must have missed something when I created the new rule, help

O.K. solved it . Should have ticked 'always publish this rule'
